AYM REVIEWS THE APPLICATION OF ŞAHİN ALPAY BEFORE THE ECHR

Turkey’s Constitutional Court (AYM) took steps before the ECHR’s review of the case of jailed journalists Mehmet Altan and Şahin Alpay on Mar. 20. AYM whose ruling was refused by the lower courts decided to review Alpay’s application on the grounds of human rights. AYM had issued a ruling before stating journalists Mehmet Altan and Şahin Alpay’s rights of freedom and security as well as freedom of the speech were violated. Istanbul’s 13th and 26th criminal courts refused to comply with AYM’s ruling. Journalists applied to the ECHR on the grounds of violations of their rights of freedom and security. The Council of Europe Secretary-General Thorbjørn Jagland said “If it comes to the point that the Constitutional Court is no longer an effective legal body domestically, the ECHR will decide on these cases.” Following these developments AYM decided to review Alpay’s application.
