JAGLAND: IF AYM’S DECISIONS ARE NOT RESPECTED THE ECHR WILL DECIDE ON THE CASES

Council of Europe Secretary-General Thorbjørn Jagland commented on the case of jailed journalists Mehmet Altan and Şahin Alpay, which the ECHR will review on Mar. 20. History was made in Turkey by a local court when it refused to comply with a ruling by the Constitutional Court (AYM) that the two journalists should be released on the grounds of human rights. Jagland said the European Court of Human Rights (ECHR) will directly review Turkish cases if Turkish courts continue to ignore rulings by Turkey’s Constitutional Court, the country’s highest judicial body. The Council of Europe’s Secretary-General Thorbjørn Jagland said “If the Constitutional Court’s decisions are not respected, applications made to that court will come directly to the ECHR,” Jagland added that “If it comes to the point that the Constitutional Court is no longer an effective legal body domestically, the ECHR will decide on these cases.”
