AYM’S SECOND RULING ABOUT ŞAHİN’S APPLICATION

Turkey’s Constitutional Court (AYM) issued another ruling before the ECHR’s review of the case of jailed journalist Şahin Alpay. The AYM had issued a second ruling about Alpay and stated that his rights of freedom and security, as well as freedom of speech, were violated. The AYM had issued the same ruling on January 11 for journalists Mehmet Altan and Şahin Alpay. However, Istanbul’s 13th and 26th criminal courts refused to comply with the AYM’s ruling. The Council of Europe Secretary-General Thorbjørn Jagland said: “If it comes to the point that the Constitutional Court is no longer an effective legal body domestically, the ECHR will decide on these cases.” Following these developments, AYM issued the same ruling for Alpay’s case.
